Police Misconduct- Hillsborough Deputy Forged Signatures On DUI Arrest Paperwork
Police misconduct can be a defense to a DUI case. When it can be shown that the officer put false information in a police report then that fact may cast doubts on the credibility of the officer.
One recent example of serious police misconduct in a DUI case can be found in a 2008 Internal Affairs Report issued by the Hillsborough County Sheriff’s Office.
An internal affairs report issued in 2008 from the Hillsborough County Sheriff’s Office makes a finding that Deputy Justin Speaks forged signatures on DUI Arrest Paperwork, including signatures or initials of three sergeants on at least two DUI reports.
The Internal Affairs report also finds that Deputy Justin Speaks committed rule violations including one count for the commission of a felony for uttering a forged instrument, and one count of conduct unbecoming an officer, and three counts of the commission of a felony for forgery.
The Internal Affairs Report and the findings contained in the report may make it difficult or impossible for the State Attorney’s Office to prosecute those cases. Additionally, other cases involving Depute Justin Speaks may be called into question.
