FR-44- Florida’s New DUI Insurance Requirements

What does a conviction for driving under the influence (“DUI”) really cost? The obvious costs routinely imposed by the court if the person enters a plea to the charge include:

  • court costs;
  • fines;
  • probation supervision fees;
  • costs for DUI school;
  • cost to buy out 50 hours of community service at $10 an hour (if permitted by the court);
  • costs to get your vehicle out of impound; and
  • money to post the bond.

Besides the obvious expenses, the DUI conviction will also cost you increased insurance premiums for at least the next three years because you will be required to obtain and maintain an FR-44 form from your insurance provider.

You should expect your insurance premiums to double or triple after a DUI conviction for at least the next three years.

Florida Statute Section 324.023 – FR44

Florida Statute Section 324.023 became effective on October 1, 2007. This Florida Statute requires proof of increased automobile insurance liability coverage for any person convicted of DUI.

The liability insurance requirement is 100/300/50 which means $100,000.00 for bodily injury or death to any one person, $300,000.00 total bodily injury or death liability, and $50,000.00 for property damage, or a combined single limit of $350,000.00.

The driver must also pay a reinstatement fee of $150, $250, or $500, unless the driver can prove that he had the policy limits at the time of the driving under the influence (“DUI”) offense.
