DUI Enforcement Units of the Tampa Police Department
Tampa Police Department's DUI enforcement unit includes a Sergeant, two (2) Corporals, and twelve (12) uniformed officers. TPD's DUI officers primarly work in the evenings and early morning hours patroling the streets throughout the City of Tampa, and responding to calls by other patrol officers who suspect a drive of impaired driving.
All of the officers on the DUI enforcement unit are required to video the entire DUI investigation. When the officer on the TPD DUI unit makes the initial stop that video should show the following:
- the driving pattern;
- the traffic stop;
- the initial questioning of the suspect;
- the manner in which the suspect exits the vehicle;
- the driver's performance on roadside agility tests (often called field sobriety exercises);
- the arrest for DUI;
- the reading of the driver's implied consent warning if the driver indicates he will refuse to take the breath test; and
- the transport to the Central Breath Testing facility at Orient Road Jail.
In many of these cases the arresting officer will later claim that the video equipment malfunctioned in some manner. If the failure to preserve the video was willful or if the officer intentionally destroyed the video, then the trial court can impose various sanctions including the dismissal of the charges, or less serious sanctions such as preventing the officer from testifying about the subject's statements or performance on field sobriety exercises.
